Terms and Conditions
1. Contract Formation & Booking Conditions
1.1 A legally binding contract is formed once the booking has been confirmed by the Provider and the required payment has been received.
1.2 The contract is entered into with the individual named on the booking or, in the case of schools or organisations, the booking organisation.
1.3 All individual course bookings are non-transferable and may not be resold, reassigned, or transferred to another person under any circumstances.
1.4 Any attempt to transfer or resell a booking will render the booking void without refund.
1.5 Cancellation charges apply as outlined in Section 4.
2. Payment & Pricing
2.1 Full payment is required at the time of booking for individual and public courses unless otherwise agreed in writing.
2.4 Failure to make payment by the due date may result in cancellation of the booking without refund of the deposit.
2.5 All prices are inclusive of VAT where applicable.
3. Vouchers
3.1 Vouchers are not sold on a sale or return basis and no refund outside of the cooling-off period will be made unless it can be demonstrated that The Smiths Outdoors has made an error in fulfilling the order.
3.2 You have a 14-day cooling-off period in which you can cancel your purchase and receive a full refund without needing to provide a reason. The cooling-off period does not apply if the voucher has been used, even partially. The cooling-off period only applies to the purchaser of the voucher, not the recipient. Once the voucher has been given to the intended recipient, the original purchaser’s right to cancel expires.
3.3 Vouchers are dated and expire 1 year from the date of purchase.
3.4 The redeemer of the voucher must attend a course prior to the expiry date.
3.5 Vouchers are redeemable according to availability.
3.6 The Smiths Outdoors cannot accept responsibility for the loss or theft of vouchers.
3.7 Vouchers are not replaceable if lost, damaged, stolen or expired and are void if altered, photocopied or reproduced.
3.8 If the redeemer wishes to attend a course other than the course for which the voucher was purchased, The Smiths Outdoors will endeavour to swap subject to availability.
Any additional amount resulting in swapping to another course will be paid by the redeemer.
Any remaining amount is not exchangeable with cash or another voucher and will be automatically forfeited.
3.9 Vouchers cannot be exchanged for cash.
3.10 No refunds will be issued on unused vouchers.
4. Participant Cancellations
4.1 Cancellations made more than 7 days prior to the course start date may be eligible for a refund, at the Provider’s discretion.
4.2 Cancellations made within 7 days of the course start date are non-refundable.
4.3 Where possible, bookings cancelled within 7 days may be rescheduled to an alternative date, subject to availability and at the Provider’s discretion.
4.4 Failure to attend without notice will be treated as a late cancellation and no refund or transfer will be offered.
5. Course Changes & Weather Conditions
5.1 All courses are subject to suitable weather conditions and ongoing dynamic risk assessment.
5.2 Where weather conditions are assessed as posing a risk to safety, the Provider reserves the right to cancel, postpone, or amend sessions.
5.3 Participants will be notified at least 24 hours prior to the session start time wherever reasonably practicable.
5.4 Where sessions are cancelled due to adverse weather, alternative dates will be offered. No refunds will be issued in these circumstances.
6. Minimum Numbers – First Aid Courses
6.1 First Aid courses require a minimum of 6 participants to run unless agreed with provider prior to booking.
6.2 Where minimum numbers are not met, the Provider reserves the right to cancel or reschedule the course.
6.3 Participants will be offered alternative dates or a transfer of booking.
6. Provider Cancellations
6.1 The Provider reserves the right to cancel or amend a course due to circumstances beyond reasonable control, including instructor illness, site restrictions, or force majeure events.
6.2 Where cancellation occurs for reasons other than weather, participants will be offered an alternative date or a full refund.
7. Participant Responsibilities & Conduct
7.1 Participants must ensure they are physically and medically fit to take part.
7.2 Relevant medical information must be disclosed at the time of booking.
7.3 All participants must follow safety instructions at all times.
7.4 Unsafe or disruptive behaviour may result in removal from the session without refund.
8. Insurance & Liability
8.1 The Smiths Outdoors has £10,000,000 of Public Liability Insurance with a reputable insurer.
8.2 The courses take place in ancient woodlands in all weather conditions, unless there is a danger to life (see section 5 & 6 for further details). You acknowledge that these environments are never completely risk free. Whilst The Smiths Outdoors make every effort to minimise risks, we will not be held liable for accidents, mishaps or losses that are not a result of negligence on the part of The Smiths Outdoors or for any accidents or losses which are due to your failure to follow our instructions.
8.3 The Smiths Outdoors cannot be held responsible for any losses or damage to your personal belongings, clothing, money or vehicle unless due to our negligence.
8.4 The Smiths Outdoors recommends that you consider taking out your own personal insurance if you require it.
8.5 The Smiths Outdoors Jack Raven Bushcraft will not be responsible for any accidents or mishaps occurring to third parties taught by you.
8.6 The Provider accepts no responsibility for loss or damage to personal property.
9. Photography & Marketing
9.1 Photographs or video recordings may be taken for marketing purposes.
9.2 Consent may be withdrawn by providing written notice prior to sessions.
10. Data Protection
10.1 Personal data is processed in accordance with UK GDPR and Data Protection legislation.
10.2 Data will be used solely for administration, safety, and communication.
